Proposition 65 (Prop 65)

California Proposition 65, formally known as the Safe Drinking Water and Toxic Enforcement Act of 1986, was enacted by the State of California in response to concerns about chemicals entering the environment and drinking water supplies.

Prop 65 requires businesses to provide “clear and reasonable” warnings to consumers if products may expose them to chemicals that the State of California has determined can cause cancer, birth defects, or other reproductive harm. Many of these chemicals occur naturally in the environment and may be present in trace amounts, such as those found in soil, air, water, or food.

Prop 65 is one of the most stringent consumer-notification laws in the United States.

 

Chemicals Covered Under Proposition 65

More than 900 chemicals are currently listed under Proposition 65. The presence of a listed chemical does not mean a product is unsafe or prohibited for sale. Instead, the law requires warnings when exposures exceed California’s extremely conservative daily exposure thresholds.

Prop 65 does not ban or restrict the sale or use of any products.

The Proposition 65 Warning

The State of California has identified the following warnings as “clear and reasonable” for consumer products:

WARNING: This product can expose you to chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.

Products That Require a Prop 65 Warning

Consumer products sold or distributed in California may be subject to Prop 65 warning requirements. Warnings are required only when exposure to a listed chemical exceeds California’s established daily exposure thresholds, based on typical or reasonably foreseeable use.

Prop 65 also applies to certain environmental and occupational exposures.

 

Why Prop 65 Warnings Are Common

If you live in California, you have likely seen Prop 65 warnings on a wide range of products and in many public places. These warnings are a standard requirement for companies doing business in California and are intended to provide transparency and consumer awareness.

Chemical Origins

Many common ingredients, minerals, and materials may contain naturally occurring trace amounts of Prop 65-listed chemicals. For example, minerals such as calcium may contain trace levels of heavy metals like lead, which are widely distributed in the environment through soil, air, water, and food.

 

Prop 65 Exposure Thresholds

California’s Prop 65 thresholds are extremely strict. For chemicals classified as carcinogens, a warning is required if exposure exceeds the No Significant Risk Level (NSRL)—defined as the level of exposure that would result in no more than one additional case of cancer in 100,000 individuals exposed daily over a lifetime.

These thresholds are often significantly lower than limits established by federal regulatory agencies.

 

Federal Safety Compliance
